Starting on April 1, 2024, most USCIS filing fees will increase

USCIS has published its final rule on fee changes for applications. Starting on April 1, 2024, most filing fees will increase.

In order to be included in the current (old) fee schedule, you must meet the following deadlines for our office:

MARCH 8, 2024: All clients must open their cases with RKL and pay all necessary legal and filing fees.

MARCH 15, 2024: All clients must bring in all required documentation.

  • This is especially important for family-based adjustment (green card) Beginning April 1, 2024, green card applicants will have to pay separate application fees to request work permission (I-765) and travel permission (I-131). Presently, adjustment applicants may file these applications at no extra cost with a copy of their I-485 receipt notice. This change will significantly raise the family-based adjustment of status filing fees from $1,760 up to $3,005 after April 1, 2024.
  • USCIS is expanding fee waivers to many humanitarian applications through adjustment of status (U, T, VAWA, SIJS). Therefore, for all humanitarian applicants, please discuss your case with your legal team to determine the best time to file.

These deadlines are to balance the best quality representation for all of our clients with the need to provide the best cost savings we can. Every application goes through a multi-step review process, including by an experienced attorney.

It’s important to know that regardless of these deadlines, there is no guarantee that any particular application will arrive before the fee increase. For example, a delay by the postal service or FedEx may require the resubmission of an application and/or the payment of additional fees.
