What is the Alien Registration Requirement?
Pursuant to a 1940 law, every foreign national who will be in the U.S. for 30 days or more must be registered and fingerprinted, including those present in the U.S. without admission or parole. They are also required to carry proof of such registration at all times.
Although this law has existed for decades, it has not been regularly enforced in recent years. However, as of April 11, 2025, the U.S. government has begun actively enforcing this registration requirement. Individuals who entered the U.S. without inspection after that date, and those not lawfully present, may now be required to register—or face possible arrest for a misdemeanor offense.
